The company is owned by Karim Yahia Cherif. We provide a software-as-a-service customer relationship management platform for account managers and customer success teams (the “Service<\/strong>“).<\/p>\n\n\n\n These Terms & Conditions (the “Terms<\/strong>“) govern access to and use of the Service, our website (including getaccusuccess.com<\/strong>) and any related apps, documentation, and support (together, the “Platform<\/strong>“). By creating an account, clicking “I agree”, or using the Platform, you agree to these Terms.<\/p>\n\n\n\n If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. You and the entity you represent are collectively referred to as the “Customer<\/strong>“, “you<\/strong>” or “your<\/strong>“.<\/p>\n\n\n\n Your use of the Platform is also subject to our Privacy Policy<\/a><\/strong>. If you purchase a paid plan, the plan-specific features and limits form part of these Terms. A Data Processing Addendum<\/strong> (“DPA<\/strong>“) forming Annex A<\/strong> below applies when AccuSuccess processes Personal Data on your behalf under EU\/UK data protection laws.<\/p>\n\n\n\n The Platform is intended for business and professional use. You represent that you are at least 18 years old and are not located in a country embargoed by the EU\/UK\/US or on any sanctions list.<\/p>\n\n\n\n You must provide accurate information, keep credentials confidential, and maintain the security of your account. You are responsible for activities under your account. Notify us promptly of any unauthorised access or security incident at [security@getaccusuccess.com<\/a>]<\/strong>.<\/p>\n\n\n\n Free trials are offered at our discretion and may be terminated at any time. Certain features may be identified as Beta<\/strong>. Beta features are provided as\u2011is<\/strong> for evaluation only and may be changed or discontinued without notice.<\/p>\n\n\n\n You will not, and will not allow others to: (a) use the Platform in violation of law or third\u2011party rights; (b) upload or transmit malware or illegal content; (c) attempt to gain unauthorised access to the Platform or related systems; (d) copy, modify, reverse engineer, or create derivative works of the Platform except as permitted by law; (e) use the Platform to send unsolicited or unlawful communications; (f) use the Platform for high\u2011risk activities where failure could lead to harm.<\/p>\n\n\n\n We may investigate and suspend or terminate access for breach of this Section.<\/p>\n\n\n\n We will implement appropriate technical and organisational measures to protect Customer Data as described in the DPA. When we process personal data on your behalf, you are the Controller<\/strong> and we are the Processor<\/strong> (as defined under the GDPR and UK GDPR). Cross\u2011border transfers will rely on an adequate mechanism (e.g., Standard Contractual Clauses) as set out in the DPA.<\/p>\n\n\n\n We maintain commercially reasonable security measures designed to protect the Platform and Customer Data. If we become aware of a Personal Data Breach affecting Customer Data, we will notify you without undue delay and provide information as required by law and the DPA.<\/p>\n\n\n\n The Platform may interoperate with third\u2011party products or services (“Third\u2011Party Services<\/strong>“). We do not control Third\u2011Party Services and are not responsible for their acts or omissions. Your use of a Third\u2011Party Service is governed by its own terms and privacy policy.<\/p>\n\n\n\n Except for the limited rights expressly granted in these Terms, AccuSuccess and its licensors retain all right, title, and interest in and to the Platform, including all software, designs, logos, and content. No rights are granted by implication.<\/p>\n\n\n\n If you provide ideas or suggestions (“Feedback<\/strong>“), you grant AccuSuccess a perpetual, irrevocable, worldwide, royalty\u2011free licence to use the Feedback without restriction or compensation.<\/p>\n\n\n\n Each party may access the other\u2019s confidential information. The receiving party will use the same degree of care it uses to protect its own confidential information (and at least reasonable care) and will use it only to perform its obligations under these Terms. These obligations do not apply to information that is public, already known, independently developed, or lawfully disclosed by a third party. Required disclosures by law are permitted with prompt notice (if lawful) to the disclosing party.<\/p>\n\n\n\n
